BMW faces a $5-Million lawsuit for design flaws involving cupholders

BMW faces a class action lawsuit in California. The lawsuit was filed last Thursday at the US District Court in Orange County. It stated that the BMW X7 and other BMWs have a design flaw. Cupholders are not permitted to get wet.

This long complaint can be summarized as follows: “cup holders have been defectively designed to hold liquid-filled cups — which is what cup holders were intended to do.” “When liquid spills into a cup holder the wires for SRS (airbag control module), which sit directly underneath the cup holder, get wet, and are damaged, causing damage the airbags.” According to the complaint, airbags could inadvertently be deployed.”

BrightK Consulting, Inc., represented atty. Hovanes Margarian. Margarian believes there are thousands upon thousands of vehicles with the same design flaw. Margarian said that cars can malfunction due to the way they are set up. Margarian also mentioned that condensation or a spillage in the cupholder could cause problems.

The lawsuit contains several complaints. Many of the complaints relate to a fault in the SRS control module. This was caused by liquid accidentally spilling onto the cupholders. The liquid then seeped into the electrical components below. The module’s replacement and repair costs exceed $2,000 in some cases. BMW will not cover this cost under warranty.
