An interesting story was featured in May. Two neighbors served a lawsuit on a California BMW owner over their loss of quiet enjoyment. Two neighbors filed a lawsuit against the defendant for allegedly reckless driving and loud exhaust in their neighborhood. They sought over $10,000 in damages. Evidently, the plaintiffs had a strong case and a judge ruled in favor of them.

Although the ruling was not as significant as the plaintiffs wanted, Tire Meets Road reports that Bryan Hillman, the BMW’s owner, received a total payment of $5,914.74. Hillman’s mother is also mentioned in the report as being part of the suit. Hillman is the alleged owner the house Hillman lives in. According to reports, the judgment was for $500 for plaintiffs and $5,000 for them. It also included court costs and other fees. Although it is not the exact amount requested, it is not a lot.

Tweets by Hillman seem to include portions of the complaints. The neighbors claim that Hillman has been driving recklessly for five years. Also included in the complaints is verbal assault and intimidation. Tire Meets Road states that the neighbors tried multiple times to resolve the problem before they went to court.

It appears that Hillman owns at most three BMWs. These include an E39 5 Series and an E46 3 Series. It is not clear if one car or all three contributed in any way to the legal decision. However, our original story featured a Hillman tweet showing him powering through a cul de sac. This has since been removed. After only 20 minutes of deliberation, it is possible that the video contributed to the decision in favor of plaintiffs. The tweet from Hillman and the report both state that the judgment was already paid.

We won’t venture into the realms of opinion. The court has found sufficient evidence to convict Hillman.
